Probate

When an individual dies owning real estate or personal property over $15,000 the estate (all of the assets) must be administered in the Probate and Family Court, whether or not there is a will. When there is a will, a person is usually named in the will to carry out the wishes of the decedent (the person who died). This person is called an executor. The executor will begin the process of finding, collecting, and liquidating the assets in accordance with the will. The executor has to keep records of the assets and expenses of the estate. After a one year period the executor can distribute the assets and close the estate. If there is no will, the court will appoint someone to administer the estate. This person is called an administrator. The administrator will begin the process of finding, collecting, and liquidating assets. After a one year period he or she will distribute those assets in accordance with Massachusetts law. I assist the executor or administrator of the estate through every step of the process. Many times in a smaller estate (assets under $15,000.00) a family member can handle the process on their own with a little guidance and direction. I am always available to answer any questions about forms or procedure to assist you in handling the process on your own.
